In no way is it "fair", but I think it's the only ruling that would not have long-lasting negative effects on the legal system. Madoff screwed a LOT of people out of their money, but this time someone snuck out under the wire and the other half of the couple is getting hosed.
I agree, but here's another side. I haven't kept up on the latest Madoff crap, but wasn't the attorney in charge of dispursing funds trying to recoup money from people that had withdrawn funds? If so, isn't it still possible they could go after the money she took out of the account. It would be funny if the judges rule in the guy's favor, allowing them to change the divorce settlement and award him some money, only for him (and her) to later be sued by the Gov't to recoup that money since it "never really existed."
