Texas bill would outlaw some TSA searches
 
This bill, H.B. No. 1937, is currently going before the Transportation and Homeland Security Committee in the Texas Senate.

(1) while acting under color of the person ’s office or

(B) [(2)] intentionally denies or impedes
another person in the exercise or enjoyment of any right,
privilege, power, or immunity, knowing the actor ’s [his] conduct is
unlawful; or
(C) [(3)] intentionally subjects another person
to sexual harassment; or
(2) while acting under color of the person ’s office or
employment without probable cause to believe the other person
committed an offense:
(A) performs a search for the purpose of granting
access to a publicly accessible building or form of transportation;
and
(B) intentionally, knowingly, or recklessly:
(i) touches the anus, sexual organ,
buttocks, or breast of the other person, including touching through
clothing; or
(ii) touches the other person in a manner
that would be offensive to a reasonable person.
(b) For purposes of this section, a person who is a public
servant acts under color of the person ’s [his] office or employment
if the person [he] acts or purports to act in an official capacity
or takes advantage of such actual or purported capacity.

They will argue that they only search those who have purchased a ticket and therefore consented to any search or detainment they find appropriate.

This won't have any teeth. I applaud the sentiment but it will be ineffective.

It doesn't. At all. The government is using Clear and Present Danger as an excuse to go around the 4th Amendment. Or should I say, MISusing

Actually, that's what's really fucked up about the whole thing. They are not federal, and many of them are even privately-owned. The TSA is simply forced upon them, scanners and all.

Of course, the owner of the company who makes the backscatter machines being a personal friend to the President and accompanying him on vacations probably doesn't have anything to do with that.

I'll have to dig it back up, but it was documented a while back when Obama went on that huge overseas vacation and everyone was all up in arms about the price tag. The backscatter guy was one of his personal entourage that joined him on the trip, then the scanners suddenly became mandatory at every airport in America. Before the Tuesday's scheduled vote US Attorney John E. Murphy wrote to Joe Straus, speaker of the state House, Senator David Dewhurst, president of the Senate, and Patsy Shaw, secretary of the Senate, basically reprising the Constitutional argument. But Murphy went farther, suggesting that if the bill were passed the TSA would have no choice but to cancel flights going into Texas in the interest of public safety.

Big Brother has spoken....and he's told us all to sit down and shut the fuck up.

America. Fuck Yeah. :/
